Boat Launch User’s Fee Ordinance

The Township of Tuscarora resolves:

Section 1. The boat launch at the Marina Park and parking lot as established by the Township shall be under the supervision of the Tuscarora Township Board.

Section 2. It shall be unlawful to enter the boat launch area at the said Marina Park Boat Launch without first paying the monetary entrance fee as required by resolution of the Township Board. The permit fees for the 2009 season shall be: (1) $5.00 per day; and (2) $35.00 per year.

Section 3. A person responsible for activity that violates Section 2, shall be guilty of a municipal civil infraction as defined in Michigan Law ( Section 113, MCL 600.113), and subject to a civil fine according to the following schedule:

First violation within a 3-year period $ 50.00
Second violation within a 3-year period $ 125.00
Third violation within a 3-year period $ 250.00
Fourth of subsequent violation within a 3-year period $ 400.00

Additionally, the violator shall pay costs which may include all direct or indirect expenses incurred by the Township in connection with the violation. In no case, however, shall costs of less than $9.00 or more than $500.00 be ordered. A violator of this ordinance shall also be subject to such additional sanctions, remedies and judicial orders as are authorized under Michigan Law. Each day a violation of this ordinance continues to exist constitutes a separate violation.

Section 4. Notice to be Published. The Township Clerk shall publish this ordinance in the manner required by law.

Section 5. When effective, this ordinance shall be in full force and effect in this governmental unit thirty (30) days after the date of publication.

The foregoing ordinance was adopted by the Tuscarora Township Board of Trustees July 7, 2009 and was duly recorded, posted and authenticated by the Supervisor and Township Clerk.

AMENDMENT TO BOAT LAUNCH ENTRANCE FEE ORDINANCE
ORDINANCE NO. 25

The Township of Tuscarora Resolves:

Section 2.  It shall be unlawful to enter the boat launch area at the said Marina Park Boat Launch without first paying the monetary entrance fee as required by resolution of the Township Board.  The permit fees are to be set annually at the February regular meeting of the Township Board.

This Amendment shall become effective thirty (30) days after publication as required by law.
