TUSCARORA TOWNSHIP ORDINANCE NO. 16
AN ORDINANCE TO AUTHORIZE ADMINISTRATIVE CLOSING OF TOWNSHIP PARKS IN CERTAIN INSTANCES TO LESSEN UNDUE CONGESTION OF TRAFFIC, PROMOTE THE SAFE, FREE AND UNHINDERED PASSAGE OF PEDESTRIANS, TO CONTROL DISORDERLY PERSONS AND TO GENERALLY PROMOTE THE HEALTH, SAFETY AND WELFARE OF THE PUBLIC.
THE TOWNSHIP OF TUSCARORA ORDAINS:
Section 1. Closure of Property.
Township owned properties or any part or parts thereof may be at any time ordered closed to the public by the Township in the event that a determination is made that such closure is necessary to lessen undue traffic congestion, promote the safe, free and unhindered passage of pedestrians, remove snow and debris, maintain the properties or other reasons relating to the health, safety and welfare of the public.
Section 2. Basis for Closures.
Sufficient basis for ordering closure of Township owned properties or any part or parts thereof shall include, but are not limited to snow plowing or removal, prevention of camping in recreational vehicles on Township property, safety hazards to persons or property created by congestion of traffic or numbers of people, security needs, control of disorderly persons, control of excessive numbers of persons using roller skates, roller blades or skateboards to the detriment of the free passage of vehicle traffic or pedestrians and the control of potential safety hazards to persons or property.
Section 3. Closure Times, Intervals and Purposes.
Any section or part of any township owned property may be declared closed by the Township at any time and for any interval of time, either temporarily or at regular and stated intervals (daily or otherwise) and either entirely or merely to certain uses as the Township shall find reasonably necessary in the public interest.
Section 4. Definitions.
a. "Township" shall mean the Township Supervisor of the Township of Tuscarora or his designee.
b. "Township owned property" shall mean parking lots, streets, bike paths, bike lanes, sidewalks, parks and public buildings.
Section 5. Penalties.
A person who fails, neglects or refuses to vacate and leave an area of township owned property which has been closed pursuant to this Ordinance, after being notified of the closure by the township and being requested to vacate and leave the closed area, is responsible for a civil infraction and subject to a penalty not to exceed THREE HUNDRED AND NO/100- ($300.00)-DOLLARS plus court costs.
Section 6. Publication.
This Ordinance shall be published once in the Straitsland Resorter, a newspaper published and circulating in said township and shall become effective thirty (30) days after publication.
