Ordinance No. 9

AN ORDINANCE TO REGULATE PERSONS PERMITTED IN SCHOOL BUILDINGS AND ON SCHOOL PROPERTIES IN THE TOWNSHIP OF TUSCARORA : TO PROVIDE PENALTIES FOR ILLEGAL ENTRY UPON SAID PREMISES OR REFUSAL TO LEAVE SAID PREMISES.

THE TOWNSHIP OF TUSCARORA ORDAINS:

Section 1 - REQUESTED ACTION.

This Ordinance is adopted pursuant to request of the Inland Lakes School District Board.

Section 2 - TRESPASS UPON SCHOOL DISTRICT LANDS OR PREMISES.

(a) No persons shall willfully enter upon the lands or premises of any public school in the township without lawful authority after having been forbidden to do so by the principal, superintendent or his designated agents. No person being upon said lands or premises may refuse or neglect to depart therefore upon being requested to do so by the superintendent, principal or his designated agent. Where signs at each school building entrance direct persons to any office or any place to obtain permission to enter and remain in said building, entry into the building by any person without complying with said direction shall be deemed prima facie violation of this Section; provided, however, that this requirement shall not apply in the case of students who are regularly enrolled and attending at said school, parents or guardians of such students, teachers or other employees.

(b) For the purpose of this Section, "students who are regularly enrolled and attending" shall not include students who are expelled or suspended from the public school.

Section 3 - PENALTIES FOR VIOLATIONS.

Any person found guilty of violating any of the provisions of this Ordinance shall be guilty of a misdemeanor punishable by a fine of not more than FIVE HUNDRED DOLLARS ($500.00) or imprisonment in the County jail for not more than NINETY (90) days, or by both such fine and imprisonment, in the discretion of the Court.

Section 4 - EFFECTIVE DATE.

This Ordinance shall become effective THIRTY (30) days after publication.
